VoIPAlarm 2 IP Alarm Signal Platform Expanded to Offer Download and Remote Access of Alarm Systems without Telephone Lines OJAI, Calif. — Nationwide alarm monitoring provider NextAlarm.com([R]), The Broadband Alarm Company([R]), has released a major upgrade to its VoIPAlarm 2 IP alarm signal transmission platform. VoIPAlarm 2 uses NextAlarm.coms Alarm Broadband Network (ABN) technology to convert existing telephone-based security alarm systems to communicate over broadband Internet connections. Previously, the platform allowed alarm systems to send their signals over the Internet, but did not allow alarm installers to program the systems remotely, as is possible over standard telephone lines. With the new upgrade, all VoIPAlarm dealers can reconfigure one of their existing ABN adapters to use specifically for downloading. This adapter is then used with standard security alarm programming modems and software to connect to the dealers customers over broadband Internet, and program them exactly as over a telephone line. “Most of the other IP communicator products on the market completely ignore this aspect of an alarm companys operation,” said Daniel Elliot, NextAlarm.coms Chief Operations Officer. “Remote programming is a huge part of the utility of modern security systems, and now VoIPAlarm 2 fully supports it.”
The Colorado Springs Police Department was following city law when it ignored a burglar alarm Wednesday morning at a north-central tavern. Police ignored the alarm because the tavern had racked up 11 false alarms since July, when the City Council enacted an ordinance intended to reduce the amount of time officers were spending responding to false alarms. Under the ordinance, police wont respond after the fourth false alarm in a 12-month period unless criminal activity has been determined, said police spokesman Lt. Skip Arms. After the fourth false alarm, the alarm company must determine whether criminal activity is occurring. But some alarm companies have placed that burden on their clients.

An unfortunate truth in the property management business exists: Sometimes tenants fall behind in rent. And while it is important to note that under the Fair Debt and Collection Act property managers are not considered debt collectors, rent delinquencies and rent collection are still problems. The Fair Debt and Collection Acts purpose is to prevent abusive practices in consumer debt collection, to encourage fair debt collection, and to enable consumers to dispute or validate the accuracy of debt information. It sets guidelines for debt collectors regarding appropriate business practices, defines rights of consumers involved with debt collectors; and recommends penalties for violating the act. When a property managers rent collection is incidental to his or her fiduciary duties to the property owner, he or she is not considered a debt collector, and therefore falls outside the statute. Still, managers worry that attempting to acquire rent might result in legal troubles because they are subject to other lawsuits related to rent collection. Also, while the act is a federal statute, various state and common law causes of action may apply to managers. The act protects consumers whose financial obligation arises primarily for personal, family or household purposes. Collection efforts relating to commercial, office, retail and other non-residential property fall outside the act, which makes residential managers much more vulnerable. Residential managers should work out a protocol for proceeding when rental payments fall into arrears. They should speak with an attorney about a roadmap that can be followed safely without running afoul of the law. Managers must make sure theyre up-to-date on new laws or court decisions that might govern their conduct, and they should exceed the standards imposed by the legislature and courts–it will help to avoid liability and high legal fees.

WHAT IS CORPORATE EDUCATION?This report discusses the extensive education and training programs established and run by corporations and other organizations, largely profitmaking enterprises whose primary purpose is something other than education, in the context of traditional higher education. As used in this report, “corporate education” is education offered by a business or industry for its own employees.HOW EXTENSIVE IS CORPORATE EDUCATION?Corporate education is an extensive, multifaceted endeavor, costing billions of dollars, educating millions of people, and absorbing many working hours annually.It is estimated, for example, that approximately $30 billion to $50 billion is spent on formal employee education and $180 billion on informal, on-the-job, education. Employees in companies with 500 or more employees–4.4 million people–can expect to receive frequent instruction paid for and provided by their employers.IS CORPORATE EDUCATION A THREAT TO HIGHER EDUCATION?As colleges and universities strive to respond to the needs of nontraditional students, they often find that corporate educators have preceded them. Corporations, with the assistance of the American Council on Education and the New York Board of Regents, have had their courses evaluated, frequently leading to the granting of credit for corporate coursework by colleges and universities.Courses offered by corporations range from remedial to postgraduate level management and technical courses. Corporations have even founded their own colleges, known as “corporate colleges.” These educational efforts potentially could threaten the health, and devalue the worth of, higher education, but in fact, corporate education is compatible with–indeed complements–traditional higher education. Higher education in the United States has been responsive to the needs of the workplace since the beginning of the federal period. The prevailing dialogue in higher education has long been the weighing of tradeoffs–practically and philosophically–between general education and what now is called “career education.” The formal recognition of instruction independent of the providers is a multifaceted and complex enterprise on the postsecondary education scene in and of itself. These efforts have accomplished two things. First, the structural conformity of noncollegiate instruction with collegiate instruction (for example, associating credit hours with contact hours) facilitates transfers and students mobility and opens up an array of potential cooperative efforts between businesses and colleges. Second, they have served as a major channel of communication between school and corporation about educational content and methods. This report presents the interaction between corporate education and these recognition processes, a path by which noncollegiate education can wend its way into the most traditional patterns of higher education. Innovations find their way into higher education in five ways, one of which is when external institutions appear on the scene to challenge, titillate, and/or draw attention to significant issues.The emergence of corporate education with its interest in formal recognition offers opportunities and challenges to higher education in the way it teaches, the students it seeks, and the perception of the purposes of education. The growth of corporate education is a stimulus to both internal collegiate debates and public policy decision making.WHAT CAN BE EXPECTED FROM THE PROLIFERATION OF CORPORATE EDUCATION?Many profitable educational ventures have been initiated that were provoked by employers recognition of their responsibility for developing their employees. Nearly all bridge decks are constructed of concrete. And almost all concrete bridge decks contain cracks–lots of cracks. Cracks are the bane of deck longevity. They allow the ingress of salts that cause corrosion of the reinforcing steel, exacerbating concrete cracking and loss of structural capacity. Why does concrete crack? Because as it dries it shrinks, and the shrinkage results in tensile stresses in the concrete, which generally exceed the tensile strength of the concrete as it is setting. Bridge decks are structural elements, hence reinforced. As the concrete dries and shrinks, the shrinkage is restrained by the reinforcing steel inducing compressive forces in the steel; compression in the steel creates tension in the concrete. The tensile strength of concrete is relatively low and takes time and maturity to develop; at early ages the tensile strength is negligible. Attempts to increase concretes tensile strength by increasing the cement content or by adding supplementary cementitious materials, such as silica fume, fail to improve the situation (or may even exacerbate it) because the additional water needed for the supplementary cementitious material increases shrinkage. For portland cement, a water-cement ratio of 0.22 to 0.25 is necessary to hydrate the cement–but at this water content the concrete is unworkable. So most concrete is placed at a w/c of 0.50 or more. The excess water results in concrete with a consistency that can be placed and finished, but the excess water isnt needed for cement hydration, and it therefore bleeds off to the surface, creating water channels. This increases total shrinkage since a significant volume of water is lost. The water channels formed during bleeding then provide a means of ingress for de-icing salts. The solution to this problem is to use shrinkage-compensating concrete, that is, concrete that contains a shrinkage-compensating cement, such as Type K, which causes the concrete to expand slightly. Since the reinforcing steel is bonded to the expanding concrete, it is placed in tension, which causes compression in the concrete. The compressive stress in the concrete negates the tensile stresses caused by shrinkage and prevents cracking. As the concrete dries and shrinks, the compressive stress is relieved, but by this time the concrete has developed some tensile strength that prevents cracking. Proper curing delays the shrinkage, allowing the concrete to develop greater tensile strength and therefore fewer cracks.

The NBERs Law and Economics Program studies the effects and causes of legal rules, with a special focus on the foundational legal subjects–property law, criminal law, contract law, and tort law–and on the operation of the legal process. In regard to the operation of the legal process, the Program examines topics such as labor markets for lawyers, litigation dynamics, judicial and agency behavior, and the determinants of legislative action. In addition, the Program studies the effects and causes of legal rules across a range of legal subjects beyond property, criminal, contract, and tort law, including corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. The Program meets twice per year, once at a mid-year program meeting and again at the NBERS Summer Institute. The Programs recent special activities include a project in the area of corporate governance, under the direction of Research Associate Lucian Bebchuk; selected papers from that project are scheduled to appear in a forthcoming issue of the Review of Financial Studies. In this article, I first describe recent research in the foundational legal subjects and then turn to work on the operation of the legal process. I conclude with an overview of work on the effects and causes of legal rules in corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. Property Law, Criminal Law, Contract Law, and Tort Law A fundamental aspect of any legal system is the structure of property rights. Recent work by Oliver Hart (13540) is the latest in an important line of papers by Hart, Sanford Grossman, and John Moore that examine the effects of a particular conception of property rights emphasizing “residual control.” In this view, the owner of an asset retains those rights to the asset that are not specifically assigned by any existing contractual commitment. While previous papers in the series have examined the effects of the residual control rights conception of property rights in the face of parties non-contractible up-front investments, the recent paper by Hart studies the effects of property rights of this form in a model with uncertainty of values and costs of a good to be traded. Harts model suggests that ex-ante contracting over asset ownership can reduce later incentives to engage in hold-up. A system that did not provide for property rights in the Grossman-Hart-Moore sense (reserving residual rights to the state rather than to the property owner) would be inferior within this framework.

Paint your house before you plant your landscape. Every neighborhood has one house that stands out like a sore thumb. You know, the one on the corner thats painted blue and has pea green shutters. The paint colors just scream ugly. Be sure to be sweet to thy neighbor and paint or stain your home in nice colors that suit your house and are in keeping with the neighborhood. The Blackstocks painted their house right after they moved in. The new paint began to peel in less than a year. Layers and layers of old paint on top of cedar shingles were beginning to cause problems; the shingles needed to be stripped. Each one was sanded to remove the old paint and expose the cedar. This was a messy project that would have destroyed a nice landscape, so it was one of the first jobs to be completed. After the cleaning, instead of repainting the house and covering the exposed cedar shingles, they used a translucent stain to allow the wood grain to show through. They chose a white stain because it gave the wood a pickled look. Joel and Laura spent a lot of time and put a lot of thought in selecting the right stain. Their advice: Drive around several neighborhoods and look at other houses and see what colors and combinations appeal to you. Then go to a home-improvement center and pick up a handful of small paint and stain samples. See what looks good on your house and on your shutters and trim.

The use of hypnosis in sports counseling and athletic training is modestly represented in the literature. However, almost all of the existing literature on sports hypnosis focuses on hypnosis for performance enhancement or aspects related to performance enhancement, such as concentration and stress reduction (Braybrooke, 1988; Collins, Doherty, Talbot, 1993; Heyman, 1987; Krenz, 1984; Liggett, 2000; Morgan, 1993; Robazza Bortoli, 1995; Stanton, 1994; Tafti, Besset, Billiard, 1992; Wojcikiewicz Orlick, 1987). This article will examine themes reflected in the literature on sports hypnosis and will explore uses of Heart-Centered Hypnotherapy (HCH) with athletes as demonstrated through case examples. Several authors provide general overviews of the uses of hypnosis in sports (Liggett, 2000; Morgan, 1993; Taylor, Horevitz, Balague, 1993). However, the majority of available literature on sports hypnosis focuses on using hypnosis for performance enhancement. In addition, many of the articles that do not focus on performance enhancement per se, describe characteristics which have a direct effect on performance. For example, this literature review found that the second most common use for hypnosis in sports was anxiety or stress reduction (Howard Reardon, 1986; Krenz, 1984; Naruse, 1965; Onestak, 1991; Wojcikiewicz Orlick, 1987). Another common theme in sports hypnosis literature (also connected to performance enhancement) is the relationship of hypnosis to mental and psychological training (Krenz, 1984; Onestak, 1991). In addition, hypnosis has been used for other aspects of performance enhancement, including strength and physical and emotional control (Diamante Baker, 1991; Howard Reardon, 1986; Johnson Kramer, 1961; Liggett Hamada, 1993; Scott, 1984), concentration (Collins, Doherty, Talbot, 1993; Schreiber, 1991), self-concept (Howard Reardon, 1986), motivation (Baybrooke, 1988; Darden, 1972; Pearson, 1983), and mood enhancement (Oakley, Norell, Cripps, 1995). Hypnosis has also been used to achieve optimal levels of performance arousal, which are necessary for the individual to achieve peak performance (Garver, 1977; Liggett, 2000; McMaster, 1993). Sports hypnosis has been further investigated in the literature in order to better understand the relationships among trance states, performance, pain, and healing. Researchers have examined occurrences of trance states in athletes and the effects of these states on performance and health (Callen, 1983; Cancio, 1991; Grove Lewis, 1996; Masters, 1992). Finally, in sports medicine, hypnosis has been utilized to decrease pain and increase healing (Ballinger, 1987; Kroger, 1988). Although performance is a primary concern for athletes, a variety of other issues exist which affect the mental health and functioning of athletes. Various developmental issues impact athletes, including identity issues, personal competence, and career planning (Jordan Denson, 1990; Pearson Petipas, 1990; Wooten, 1994). Athletes must also confront identity issues related to their level of participation and achievement in sports (Greendorfor Blinde, 1985; Ogilivie Howe, 1982; Svoboda Vanek, 1982). For athletes who focus solely on sports activities, self-esteem, identity, and social affiliation may be entirely dependent upon their athletic involvement (Gordett, 1985; Pearson Petipas, 1990). Once participation in athletics ceases (either voluntarily or involuntarily), the individual may experience crises related to identity, self-efficacy, and helplessness (Kleiber Brock, 1992). Athletes transitioning out of sports often must deal with rebuilding identity in a non-athletic context, constructing career-life plans, and developing personal competencies (Wooten Hinkle, 1991). These examples demonstrate the broad spectrum of developmental and identity issues that exist in the world of the athlete. However, the use of hypnosis in dealing with athletes developmental and identity issues has been conspicuously absent from the existing literature. Almost all descriptions of hypnosis in sports counseling are fundamentally connected to performance enhancement.

INTRODUCTION A Jewish lawyer has obligations to God, to the Jewish people, to humanity, and to the legal profession. These obligations pull the lawyer in many different directions. (3) One can only pray for the wisdom of Solomon when trying to reconcile these potentially conflicting obligations. This dilemma prompted Professor Sadiq Reza to comment, concerning religious public defenders, that a lawyer “must be `schizophrenic, separating his professional obligations from his religious commitments,” (4) to ensure that the lawyer “remain[s] faithful to his client.” (5) Although many problems arise from being a Jewish lawyer, and specifically a Jewish criminal defense lawyer, this Comment argues that an attorney need not become “schizophrenic” (6) to reconcile his obligations with the demands of his profession. Rather, a careful analysis must be made to determine whether the specific problems can be overcome. (7) In the event that the problems facing the Jewish lawyer prove to be insurmountable, this Comment argues that the Jewish lawyer may not practice that field of law. Part I of this Comment discusses the applicability of substantive Jewish Law outside of a Jewish court. (8) Part II analyzes general issues of Jewish Law that conflict with the duties of a criminal defense lawyer. Part III examines some common settings in criminal defense work and their ramifications under Jewish Law, and argues that in many instances it is impossible to be a criminal defense lawyer, and at the same time obey Jewish Law.
